TERMS AND CONDITIONS

You are the "Client", and TRIBE Creative is the "Designer". 

Work: TRIBE Creative agrees to produce project materials (the “Work”) at the request of the client for fees agreed upon in advance and delivery of the Work by an agreed-upon deadline. TRIBE Creative will cooperate with Client in editing and otherwise reviewing the Work prior to completion and launch.

Confidentiality: TRIBE Creative acknowledges that we may receive or have access to information which relates to the Client’s past, present, or future products, vendor lists, creative works, marketing strategies, pending projects/proposals, and other proprietary information. TRIBE Creative agrees to protect the confidentiality of the Client’s proprietary information and all physical forms thereof, whether disclosed before this Agreement is signed or afterward.

Accreditation and Promotion: TRIBE Creative may use images of the Client’s website for use in all forms of promotional material, social media, print, portfolios, galleries, and online stores. TRIBE Creative can also display materials and final work created for Client on the Designer’s website (www.tribecreativenyc.com), this includes TRIBE Creative’s accreditation logo with a link to our website in the footer that may not be removed at any time.

Compensation: Client agrees to pay TRIBE Creative a nonrefundable deposit equaling 50% of the total project cost before any services are provided, and the remaining 50% is to be paid before any workable files are delivered. If the parameters of the Work change, TRIBE Creative will inform Client and they can renegotiate the Work’s cost.

Schedule: The Work outlined in this agreement will be turned around within a reasonable, non-rush schedule to be determined, where possible, and mutually agreed upon at the start of each project. Our schedules assume timely review and response by Client of all deliverables.

Client Approvals: Client will approve and proofread all final designs, type, press proofs and test sites. TRIBE Creative will make all efforts to ensure that no information is misrepresented. However, Client assumes all responsibility for content they provide (this does not apply to content written by TRIBE Creative). Client’s approval of all tangible materials and artwork will be assumed after the work has been submitted to Client for review, unless Client indicates otherwise in writing.

Client Changes: In order to avoid errors, changes and corrections will not be taken over the telephone and must be provided electronically. TRIBE Creative may decline, or charge additionally for, work reasonably deemed to be beyond the Scope of Work.

Cancellation: Both parties understand that the Client or TRIBE Creative may terminate the service at any time if, for any reason, the relationship is deemed unsatisfactory by either party. Upon written cancellation, Client is responsible for payment for all expenses incurred and any work done towards the completion of the project based on the percentage of the project completed that is determined by TRIBE Creative. With any service that is purchased, we reserve the right to cancel if you do not respond within 21 days, in which the 50% deposit will not be refunded. Should Client cancel the project following its completion, Client is responsible for full payment as per the agreed upon estimate plus all expenses incurred. In the event of cancellation, TRIBE Creative retains ownership of all copyrights and original work created.
